Legacy Access Agreement

This Legacy Access Agreement ("Agreement") is between Viveir and each person who has been designated as a Legacy Contact by a Viveir user (the "Primary User") and who accesses the Primary User's Viveir account after a triggering event such as the Primary User's death, incapacitation, or a scheduled release. By accessing a Primary User's Viveir content as a Legacy Contact, you agree to this Agreement.

1. What You Are Receiving Access To

As a designated Legacy Contact, you have been granted access to some or all of the content the Primary User preserved in Viveir. The specific access granted to you is controlled by the Primary User; it may include memories, photos, recorded voice and video, AI conversation with the Primary User's voice clone, timed messages addressed to you, documents, and the public memorial page.

2. Your Role and Responsibilities

You agree to:

  • Use the Primary User's content to honor and remember them, not for any commercial purpose.
  • Respect the boundaries and access settings the Primary User established. Access rules are not recommendations; they are binding.
  • Keep your own account credentials secure. Do not share login access with other people, including other family members, unless they are also designated Legacy Contacts.
  • Notify Viveir if you believe access has been granted in error, if you wish to decline access, or if you become aware that the Primary User did not in fact die or become incapacitated.

3. What You May Not Do

You may not:

  • Publish, sell, license, or commercially exploit the Primary User's recordings, Voice Clone output, written content, photos, or other material.
  • Use the Primary User's Voice Clone to generate audio that could be reasonably understood as an authentic statement by the Primary User, whether for deception, advocacy, endorsement, or any other misleading purpose.
  • Use AI-generated content from the Primary User's profile to defame, harass, or disparage any person, including the Primary User themselves.
  • Redistribute voice or video material beyond channels the Primary User explicitly authorized (for example, the public memorial page, or sharing within the designated family group).
  • Make legal, medical, financial, or other significant decisions based solely on conversations with an AI trained on the Primary User's data. Those conversations are approximations and must not substitute for documented legal instruments such as a will, trust, or advance directive.
  • Attempt to recover, export, or use the Primary User's Voice Clone outside of Viveir.

4. Subscription Required for Ongoing Access

Access to active features (AI conversation, new timed message delivery, memorial page hosting) requires a Family Access subscription. Viveir offers Family Access plans described on the pricing page. If all Legacy Contacts fail to maintain a Family Access subscription for 180 consecutive days after the triggering event, Viveir will offer a final data export and then permanently delete the Primary User's content in accordance with the Terms of Service.

5. Multiple Legacy Contacts

A Primary User may designate more than one Legacy Contact. Each Legacy Contact has the access the Primary User assigned to them, which may differ from what other Legacy Contacts receive. Legacy Contacts do not automatically have authority over other Legacy Contacts' accounts or access.

6. Verification

Before we grant Legacy Access, Viveir may require reasonable verification of the triggering event (for example, a death certificate, obituary, or corroborating communications). Until Viveir has completed verification it considers sufficient, access may be limited or deferred. We also reserve the right to pause access if we receive credible information that a triggering event did not in fact occur or that access was obtained through fraud.

7. Disputes Among Family Members

Viveir is not a probate court and cannot resolve disputes among family members over a deceased person's content or wishes. If such a dispute arises, we may, at our sole discretion, pause access for affected Legacy Contacts pending resolution. We encourage families to resolve disputes through their own communication or through legal process.

8. Termination of Access

Viveir may terminate a Legacy Contact's access if the Legacy Contact violates this Agreement, if access was obtained through fraud, or if required by a court order or other legal process. We will attempt to notify the Legacy Contact before termination when possible.

A Legacy Contact may voluntarily relinquish access at any time by notifying Viveir.

9. Limitation of Liability

Legacy Contacts access the Primary User's content "as is." Viveir makes no warranty that the content is complete, accurate, or reflective of the Primary User's true wishes. AI-generated conversations and audio may contain errors or unexpected output. Viveir is not liable for emotional, financial, or other harm that may result from interacting with the Primary User's preserved content.

The overall liability cap, disclaimers, and indemnification obligations described in the Viveir Terms of Service apply to Legacy Contacts to the same extent as they apply to Primary Users.

10. Governing Law

This Agreement is governed by the laws of the Commonwealth of Massachusetts. Any disputes arising from this Agreement are subject to the dispute resolution provisions of the Viveir Terms of Service.

11. Your Acknowledgment

By accessing the Primary User's Viveir content as a Legacy Contact, you confirm that:

  • You are at least 18 years old.
  • You understand that your access is a privilege granted by the Primary User, not a property right.
  • You agree to use the content with respect for the Primary User's memory and within the limits of this Agreement.
  • You will not use the content for any purpose prohibited in Section 3.
