Voice and Likeness Consent

This Voice and Likeness Consent ("Consent") describes what happens when you create an AI voice clone using Viveir, what it will be used for, and your rights to control, limit, or revoke that use. You must accept this Consent before Viveir creates a voice clone of your voice. This Consent supplements the Viveir Terms of Service.
1. What You Are Consenting To
You consent to Viveir:
- Creating a machine-learning representation of your voice (your "Voice Clone") from audio recordings that you upload or create using Viveir.
- Storing your Voice Clone with our voice technology provider, currently ElevenLabs, Inc., as necessary to generate audio on your direction.
- Using your Voice Clone to generate audio that speaks words you have written, words generated by an AI system you have authorized, or words contributed during your life that were stored in your Viveir profile.
- Playing that generated audio back to you during your lifetime and, after a triggering event as defined in the Terms of Service, to the family members or other Legacy Contacts you have designated.
2. What You Are NOT Consenting To
You are not consenting to:
- Use of your Voice Clone for any commercial purpose outside of providing the Viveir service to you and your designated Legacy Contacts.
- Use of your Voice Clone for advertising, endorsements, or political speech.
- Creation of voice content designed to deceive third parties about your identity, views, or actions.
- Use by any person who is not either you or a Legacy Contact you have designated with voice-access rights.
- Training of third-party AI models using your voice data, except to the extent strictly necessary to create and operate your personal Voice Clone.
3. Accuracy and AI Limitations
AI-generated voice audio approximates your voice but is not identical to you. It may mispronounce words, adopt unintended inflections, or produce content you would not have actually said. Content spoken by your Voice Clone is generated by software; it is not a recording of you saying those words, even when the content was drawn from your own writing.
You acknowledge these limitations and agree that audio generated by your Voice Clone is Viveir's best-effort synthetic output, not an authenticated statement by you.
4. Your Control Over the Voice Clone
4.1 Reviewing and Previewing
You may preview your Voice Clone at any time through the Viveir "Talk to Me" feature. This lets you hear what your family will hear before any content is delivered.
4.2 Revoking the Voice Clone
You may delete your Voice Clone at any time through your account settings. Deletion removes the voice model from our voice provider and stops future generation using your Voice Clone. Audio already generated and already delivered to a recipient cannot be recalled. Audio stored in your account that has not yet been delivered will stop playing if your Voice Clone is deleted.
4.3 Effect of Revocation After Death
If you do not revoke your Voice Clone during your life, your Legacy Contacts will be able to hear audio generated by your Voice Clone in accordance with the access rules you set. If you wish for your Voice Clone to be destroyed upon your death rather than preserved for Legacy Contacts, you must select that option in your account settings; otherwise, the default is to preserve the Voice Clone for your designated Legacy Contacts.
5. Storage and Security
Your voice recordings and Voice Clone are stored securely using the practices described in the Viveir Privacy Policy. We do not transfer your Voice Clone to any third party outside of our voice technology provider, and we do not permit that provider to use your voice for any purpose other than generating audio at your direction.
6. Use by Legacy Contacts After a Triggering Event
After a triggering event (your death, your incapacitation, or a scheduled release), Legacy Contacts you have designated with voice-access rights will be able to request audio generation using your Voice Clone within the limits you set. Legacy Contacts are bound by the Legacy Access Agreement, which forbids commercial use, impersonation, defamatory uses, and public redistribution of audio beyond the memorial page and other sharing you have explicitly authorized.
7. No Use Without Consent
Viveir will not create a Voice Clone of anyone other than you. You may not upload recordings of another person's voice for the purpose of cloning their voice without their own explicit consent documented through the same process.
8. Governing Law
This Consent is governed by the laws of the Commonwealth of Massachusetts. It supplements but does not replace any provision of the Terms of Service or Privacy Policy. If there is any conflict, the Terms of Service govern except on subjects specifically addressed in this Consent, where this Consent governs.
9. Your Acknowledgment
By clicking "I Consent" in Viveir and proceeding with voice cloning, you confirm that:
- You are at least 18 years old and a resident of the United States.
- The voice being cloned is your own.
- You have read and understood this Consent.
- You agree to the creation and use of your Voice Clone as described above.
You may decline to consent and continue using Viveir without the voice-cloning feature. You may withdraw consent at any time as described in Section 4.2.
